1. Introduction

These Terms of Service govern your use of Automate CRM, a white-labelled software service provided by Automate Digital.

By accessing or using Automate CRM, you agree to comply with these Terms. If you do not agree, you must not use the Platform.

2. Nature of Service

Automate CRM is a white-labelled software platform powered by GoHighLevel. It provides business, CRM, marketing automation and communication tools.

  • Marketing automation
  • Email and SMS communications
  • Funnels, websites, forms and surveys
  • Appointment scheduling
  • Courses and memberships
  • Reputation management
  • AI and workflow tools
  • Third-party integrations

3. Fees and Billing

Access to Automate CRM is provided on a subscription basis. Fees are charged in advance and may be billed monthly or annually depending on your selected plan.

If payment fails, we may suspend or restrict access to your account until outstanding amounts are paid.

Unless otherwise required by Australian Consumer Law, subscription fees are non-refundable.

4. Acceptable Use

You agree not to use Automate CRM for:

  • Spam or unsolicited communications
  • Illegal, misleading or deceptive activities
  • Sending malicious software or harmful content
  • Violating privacy, intellectual property or anti-spam laws
  • Fraudulent, abusive or prohibited content
  • Activities that may damage platform reputation or deliverability

5. Compliance Responsibilities

You are responsible for ensuring your use of Automate CRM complies with all applicable laws and regulations, including the Australian Spam Act 2003, Privacy Act 1988, and any international laws that may apply.

You are also responsible for obtaining proper consent from contacts before sending email, SMS or other communications.

6. Data Ownership

You retain ownership of the data you upload or create within Automate CRM.

You grant us a limited licence to host, process, transmit and back up your data solely for the purpose of providing the service.

7. Third-Party Services

Automate CRM may integrate with third-party providers including payment gateways, telephony services, email providers, social platforms, AI services and other software tools.

We are not responsible for outages, pricing changes, policy changes or service interruptions caused by third-party providers.

8. Email and SMS Deliverability

While Automate CRM provides tools to assist with email and SMS delivery, we do not guarantee deliverability, inbox placement, open rates, click rates or message performance.

Deliverability may be affected by sending practices, domain reputation, content quality, recipient engagement and third-party provider policies.

9. Account Suspension or Termination

We may suspend or terminate access if you breach these Terms, pose a compliance or reputational risk, or fail to pay required fees.

You may cancel your subscription at any time. Cancellation stops future billing but does not automatically delete your data unless requested.

10. Account Transfers and Platform Migration

Transfer Back to GoHighLevel

Automate CRM operates as a white-labelled platform powered by GoHighLevel. If a customer wishes to move their sub-account away from Automate CRM and back to GoHighLevel directly, this will only be facilitated using GoHighLevel’s official “ejection” process.

We do not provide full account exports, cloning transfers, snapshots or alternative migration methods outside of the official ejection process.

We do not guarantee that all features, settings, workflows, integrations, templates, phone services, email services, AI configurations or historical data will function identically after transfer.

11. Intellectual Property

All branding, documentation, training materials, website content and proprietary systems provided by Automate Digital remain our intellectual property unless otherwise stated.

12. Limitation of Liability

To the maximum extent permitted by law, Automate Digital is not liable for indirect loss, loss of profits, loss of business opportunities, data loss, service interruptions, third-party outages, deliverability issues or platform changes made by GoHighLevel or other providers.

Our total liability relating to Automate CRM shall not exceed the fees paid by you in the previous three months.

13. Australian Consumer Law

Nothing in these Terms excludes rights or guarantees that cannot legally be excluded under Australian Consumer Law.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of Automate CRM after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of Queensland, Australia.
